Good Schedules and the Threat of Claims

As a Project Controls or Scheduling Manager (in the construction industry), how much, if at all, does the potential for downstream disputes color efforts of the Project Team to develop a schedule that is best for managing the project? To be sure, if one were to develop a schedule with maximum consideration of downstream claims, that schedule would look and function differently than if it were developed for maximum utlity as a project coordination and communication tool. I think we can agree that, depending on the which functional priority is chosen (whether subtle or blatant), the schedule would look and act differently. The question is: how often, if at all, do you find yourself, as manager, torn between developing a schedule that is best-suited to run the job, and one that is most flexibly postured for possible downstream claims? Maybe the question is worded the best, but you get the question. Is this ever a problem for you?
